Welcome to therobertsfdn.org (the "Site"), operated by The Roberts Foundation, a Texas nonprofit corporation and 501(c)(3) tax-exempt organization ("the Foundation," "we," "us," or "our"). These Terms of Use (the "Terms") govern your access to and use of the Site and the services, content, and programs we offer through it (collectively, the "Services").

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. If you are using the Site on behalf of a minor, student, parent, guardian, school, organization, or other entity, you represent and warrant that you are authorized to accept these Terms on that person’s or entity’s behalf.

1. Eligibility and Use by Minors
You must be at least 13 years of age to use the Site independently. If you are between 13 and 17 years of age, you may use the Site only with the involvement and consent of a parent or legal guardian, and a parent or guardian must complete any program application on your behalf or with you. If you are under 13, you may not submit personal information through the Site, and a parent or guardian must contact us directly on your behalf.

By using the Site, you represent that you meet these eligibility requirements and that any information you submit is true and accurate. If you are submitting information about another person (such as a child for whom you are a parent or guardian), you represent that you have the authority to do so. We may refuse, remove, or disable any submission or participation if we reasonably believe that the required parental or guardian consent has not been obtained or cannot be verified. We do not knowingly collect personal information online from children under 13 except as permitted by applicable law and with required parental involvement.

2. Description of Services

The Foundation provides programs and resources for young people, including scholarships, financial literacy education, civic empowerment initiatives, and mentorship opportunities. The Site provides information about these programs and may allow visitors to apply, donate, subscribe to communications, or otherwise engage with the Foundation.

The Foundation may add, modify, suspend, or discontinue any program, feature, or part of the Site at any time without notice. All programs, opportunities, eligibility criteria, deadlines, award amounts, benefits, and program terms are offered subject to availability of funding, staffing, volunteer participation, internal policies, and applicable law.


3. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

· Submit false, misleading, incomplete, or fraudulent information, including on any application;

· Impersonate any person or misrepresent your affiliation with any person or organization;

· Interfere with or disrupt the Site, servers, or networks connected to the Site;

· Attempt to gain unauthorized access to any portion of the Site, other user accounts, or related systems;

· Upload or transmit any virus, malware, or other harmful code;

· Use any robot, spider, scraper, crawler, data mining tool, artificial intelligence training tool, or other automated means to access the Site for any purpose without our written permission;

· Collect, harvest, store, or disclose personal information about other users;

· Use the Site to harass, abuse, threaten, exploit, or harm any person, particularly minors;

· Post or transmit any content that is unlawful, defamatory, obscene, discriminatory, invasive of privacy, or otherwise objectionable;

· Use the Site to promote any commercial product or service without our written consent; or

· Attempt to manipulate, interfere with, or circumvent any application, review, interview, selection, verification, payment, security, or eligibility process used by the Foundation.

We reserve the right to investigate and take appropriate action — including legal action, denial of access, disqualification from programs, revocation of awards or participation, removal of content, and referral to law enforcement — against anyone who violates these Terms.

4. Scholarship, Mentorship, and Program Applications

Applying for a Foundation program does not guarantee selection, award, or participation. All decisions regarding eligibility, selection, award amounts, mentorship matches, interview invitations, deadlines, required documentation, disbursement timing, suspension, and continued participation are at the sole discretion of the Foundation. The Foundation may modify program criteria, deadlines, award amounts, documentation requirements, and program rules at any time, with or without notice.

By submitting an application, you agree that:

·    The information you provide is true, accurate, and complete to the best of your knowledge;

·    You authorize the Foundation to verify the information you provide, including by contacting schools, references, employers, service providers, government agencies, or other third parties identified in your application, to the extent permitted by law;

·    You will promptly update us if any material information changes;

·    You will provide any additional documentation or consents we reasonably request;

·    The Foundation is not obligated to return application materials, and submission does not create any contractual, fiduciary, scholarship, mentorship, admissions, employment, agency, or other relationship until and unless the Foundation issues a written award or program agreement signed or expressly approved by the Foundation; and

·    The Foundation may deny, rescind, suspend, withhold, or revoke any application, award, payment, match, or participation if it determines, in its sole discretion, that eligibility requirements were not met, information was inaccurate or incomplete, required documentation or consent was not provided, funding or program availability changed, safety or conduct concerns exist, or participation would be inconsistent with the Foundation’s mission, policies, or legal obligations.

Submitting false or misleading information in an application is grounds for disqualification, revocation of any award, recovery of funds to the extent permitted by law, and possible referral to authorities.


5. Donations

Donations made through the Site are subject to our Donor Privacy Policy. The Foundation is a 501(c)(3) tax-exempt organization, and contributions are tax-deductible to the fullest extent allowed by law. No goods or services are provided in exchange for your contribution unless explicitly stated. Donations are generally non-refundable, except as described in the Donor Privacy Policy. We use third-party payment processors for online donations and do not warrant that any donation processing service will be uninterrupted, secure, or error-free. You are responsible for verifying the accuracy of your donation information before submission.


6. Intellectual Property

All content on the Site, including text, graphics, logos, images, videos, design elements, software, compilations, and other materials (collectively, the "Content"), is owned by the Foundation or its licensors and is protected by copyright, trademark, and other intellectual property laws. "The Roberts Foundation" name and logo are trademarks of the Foundation.

You may view and download Content for your personal, non-commercial use only, provided that you retain all copyright and other proprietary notices. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, transmit, sell, license, reverse engineer, or commercially exploit any Content without our prior written consent.

7. User Submissions

If you submit any content to the Site or to the Foundation — including application materials, testimonials, essays, photos, videos, audio, comments, messages, or other materials (collectively, "Submissions") — you grant the Foundation a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, store, modify, adapt, publish, translate, create derivative works from, distribute, and display the Submissions for the Foundation's nonprofit, charitable, educational, administrative, archival, compliance, and promotional purposes, in any media now known or later developed, subject to applicable law and our Privacy Policy.

For Submissions involving minors, the parent or legal guardian must provide consent on the minor's behalf and represents that they have the legal authority to grant this license and any requested publicity, media, or release rights. If you wish to withdraw consent for a specific Submission, contact us, and we will make reasonable efforts to remove the Submission from materials within our control, subject to the practical limitations of materials already distributed, published, archived, backed up, submitted for compliance purposes, or incorporated into internal records.

You represent and warrant that any Submission is original to you (or you have the necessary rights), does not infringe the rights of any third party, does not violate any law, is not misleading or defamatory, and does not include personal information of another person except as permitted and authorized by applicable law. We may, but are not obligated to, monitor, review, edit, remove, or decline to use any Submission for any reason.


8. Third-Party Links and Services

The Site may contain links to websites operated by third parties, including partner organizations, schools, scholarship platforms, donation processors, social media platforms, and related projects. We provide these links for convenience and do not endorse, control, or assume responsibility for the content, privacy practices, security, accessibility, availability, or operations of any third-party site or service. Your interactions with third-party sites are governed solely by those sites' terms and policies.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND PROGRAMS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Information on the Site is provided for general informational purposes only and is not intended as legal, financial, tax, educational, medical, mental health, admissions, or other professional advice. You should consult with a qualified professional before acting on any information you obtain from the Site.

The Foundation does not warrant that any applicant will receive a scholarship, mentorship opportunity, grant, admission outcome, employment opportunity, financial aid result, or any other benefit through use of the Site or participation in any program. The Foundation is not responsible for decisions made by schools, mentors, donors, partners, service providers, or other third parties.


10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE FOUNDATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, CONTRACTORS, DONORS, PROGRAM PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, OPPORTUNITY, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY CONTENT, SERVICES, OR PROGRAMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE FOUNDATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION WILL NOT BE LIABLE FOR ANY CLAIMS ARISING OUT OF OR RELATING TO (A) ANY APPLICATION, NON-SELECTION, DISQUALIFICATION, OR REVOCATION OF AN AWARD OR PARTICIPATION; (B) ACTS OR OMISSIONS OF ANY SCHOOL, MENTOR, VOLUNTEER, DONOR, PARTNER, PAYMENT PROCESSOR, OR OTHER THIRD PARTY; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (D) DELAYS, INTERRUPTIONS, OR ERRORS IN SITE OPERATION; OR (E) CONTENT SUBMITTED BY USERS OR THIRD PARTIES.

IN NO EVENT WILL THE FOUNDATION'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE FOUNDATION (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.


11. Indemnification

You agree to indemnify, defend, and hold harmless the Foundation and its directors, officers, employees, volunteers, agents, contractors, successors, assigns, and affiliates from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of the Site; (c) your violation of any law or the rights of any third party; (d) any Submission you provide; or (e) any information or materials submitted on behalf of a minor or other third party by you.


12. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site that is not resolved through informal discussion shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum.


13. Informal Dispute Resolution

Before filing any claim against the Foundation, you agree to first contact us at the address in Section 17 and attempt to resolve the dispute informally. We will make a good-faith effort to address your concern within 60 days. You agree that any claim arising out of or relating to the Site or these Terms must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or mass action, to the fullest extent permitted by law.


14. Termination

We may suspend, restrict, or terminate your access to the Site or any portion of the Services at any time, with or without notice, if we believe you have violated these Terms, provided inaccurate information, failed to provide requested documentation or consents, engaged in conduct harmful to the Foundation or others, or created legal, reputational, or safety risk for the Foundation, program participants, or the public. Upon termination, the provisions of these Terms that by their nature should survive — including Sections 6, 7, 9, 10, 11, 12, 13, and 16 — will continue to apply.


15. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the "Last Updated" date. Material changes will be communicated through prominent notice on the Site. Your continued use of the Site after the effective date of any change indicates your acceptance of the revised Terms.


16. Miscellaneous

These Terms, together with our Privacy Policy and Donor Privacy Policy, constitute the entire agreement between you and the Foundation regarding the Site. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this sentence is void. We may assign these Terms in connection with a merger, transfer of assets, reorganization, or operation of the Site or our programs. Section headings are for convenience only and do not affect interpretation.
